The Right to Pass Out “Know Your Rights” Leaflets
In June 2013 Joe Marogil was passing out leaflets at the Fulton Street Farmers Market in Grand Rapids about upcoming ACLU “Know Your Rights” events. The market director told him to leave and threatened to have him arrested if he continued. The ACLU of Michigan contacted city officials and asked to meet with them regarding the First Amendment right to distribute non-commercial flyers in public areas. After lengthy negotiations, in February 2015 the city agreed to change its policies and allow petitioning, leafleting and other free speech activities in designated areas of the market.
