LGBT Rights

The ACLU has advocated on behalf of Lesbian Gay Bisexual and Transgender people for more than 70 years and, in 1986, founded the LGBT & AIDS Project. The LGBT Project fights discrimination and moves public opinion on LGBT rights through the courts, legislatures and public education. The mission of the Project is to foster a society in which LGBT people and people with HIV/AIDS enjoy the basic rights of equality, privacy and personal autonomy, and freedom of expression and association.

On March 21, 2014, Judge Bernard Friedman entered a final judgment in DeBoer v. Snyder, declaring Michigan’s ban on marriage for same-sex couples unconstitutional and enjoining the state from prohibiting such marriages. The following day, approximately 300 same-sex couples got married in Michigan before the Sixth Circuit Court of Appeals issued an order staying Judge Friedman’s decision.

A non-ACLU lawsuit was filed in federal court on behalf of two lesbian mothers who were denied the ability to jointly adopt their three special-needs children. The suit alleges that to deny gay parents the right to jointly adopt children violates the equal protection rights of both parents and children. After Judge Bernard Friedman suggested that the case is really about same-sex marriage equality, the plaintiffs amended their complaint to challenge the denial of their right to marry as well.

The mother of two students at Howell High School filed a lawsuit alleging that the school district’s anti-bullying policies violate her children’s rights to freedom of speech and religion because they were raised to believe that homosexuality is wrong.

In 2012, the ACLU filed a friend-of-the-court brief in the case, arguing that both anti-bullying policies and the First Amendment can co-exist, and that Howell’s policy does not impinge on religious students’ First Amendment rights.

In May 2015 the ACLU filed a federal lawsuit challenging the Michigan Secretary of State’s policy making it extremely burdensome and in some cases impossible for a transgender person to get the gender marker on their driver’s license changed.  Michigan’s policy required an amended birth certificate showing the correct gender.  For persons born in Michigan, changing the birth certificate requires “sexual reassignment surgery,” which many transgender people either choose not to undergo, or cannot undergo due to its high costs or possible medical complications.  For persons born in other state

Aimee Stephens worked as director of a Detroit-area funeral home for six years, responsible for preparing and embalming bodies.  Although she is transgender, she initially hid her female appearance and identity from her employer during her employment, presenting as male.  When Ms. Stephens informed her employer that she had been diagnosed with gender dysphoria and would begin presenting as female at work, she was fired.

In the wake of two recent attacks against transgender women in Detroit, the ACLU of Michigan is again calling on legislators to update state civil-rights protections and hate-crime laws to include safeguards for gender identity and sexual orientation. Jay Kaplan, staff attorney for the ACLU of Michigan LGBT Project, issued the following statement today:

"We are both grief-stricken and outraged over separate shooting incidents, one of them fatal, involving two transgender women of color in the City of Detroit in the past week.

Despite the recent landmark Supreme Court ruling in favor of the freedom to marry, the road to full equality for everyone in our state continues to be pocked with obstacles. Few obstacles currently loom as large as the potential danger of SB 4, the "religious freedom restoration act" (RFRA) now being debated in the state legislature.

If passed, the bill would allow faith to be used to legally discriminate against LGBT communities and others.

Forty-five years after the American Civil Liberties Union filed the first-ever freedom-to-marry lawsuit in 1970, the US Supreme Court on June 26, 2015, struck down discriminatory marriage bans in Michigan and three other states, its historic decision securing marriage equality for gay and lesbian couples all across the country.

The ruling invalidates discriminatory laws in Kentucky, Michigan, Ohio, and Tennessee upheld by the Sixth Circuit Court of Appeals, and as a practical matter, requires all 50 states to allow same-sex couples to marry.
