In a unanimous decision late yesterday, the Michigan Supreme Court struck down the City of Wyoming’s ordinance that bans medical marijuana because it directly violates the state’s Medical Marihuana Act.

The American Civil Liberties Union today argued before the U.S. Court of Appeals for the Sixth Circuit that its lawsuit charging Wal-Mart and the manager of its Battle Creek, Mich. store with wrongfully firing an employee for using medical marijuana in accordance with state law should be reinstated. The patient, Joseph Casias, used marijuana outside of work to treat the painful symptoms of an inoperable brain tumor and cancer.

Joseph Casias has battled sinus cancer and an inoperable brain tumor for more than a decade. His condition has required extensive treatment and chemotherapy, interferes with his ability to speak, and is a source of severe and daily pain. The pain relief medicine prescribed by Joseph's oncologist helped a little, but he continued to experience constant pain and nausea, a side effect of the medication.

The American Civil Liberties Union today said it will appeal a decision by a federal judge to dismiss an ACLU lawsuit filed in June against Wal-Mart and the manager of its Battle Creek, Michigan store for wrongfully firing an employee for using medical marijuana in accordance with state law to treat the painful symptoms of an inoperable brain tumor and cancer.

BATTLE CREEK, Mich. – The American Civil Liberties Union and ACLU of Michigan in partnership with the law firm of Daniel W. Grow, PLLC, filed a lawsuit today against Wal-Mart Stores, Inc. and the manager of its Battle Creek store for wrongfully firing an employee for using medicinal marijuana in accordance with state law to treat the painful symptoms of an inoperable brain tumor and cancer.
